Stems

I've started my transcription for a drum track and layer 1 is all parts you'd play with your hands and i made the stems point up and layer 2 is all parts you use with your feet which is really only bass drum and hi-hat foot pedal with the stems pointing down. But now when i go to put some cymbals in the stems point donw but i made sure i was in layer 1 but they still point down is there a way to set it for good to have stems for bass drum and hi hat pedal facing down and the rest facing up?
